Q&A - must they prove care responsibilities?

Q. Can we demand that any employees who make statutory flexible working requests to care for children provide us with hard evidence in their application that this personal responsibility really exists?

A. No, you can’t; there’s no legal requirement on them to do this. However, if you think that they’re abusing the legislation, e.g. you’ve never heard them refer to any children in their care, then you can request further details on the caring relationship before making a decision.

You can’t demand employees provide supporting evidence when making a flexible working application. But if you think they’re abusing the law, you can ask for further information before making a decision.
