SSP: is there an “upper age limit”?

Q. During any periods of sickness absence, we pay our employees Statutory Sick Pay (SSP) only. However, we now have a couple of members of staff who are aged 65 or over. Is there is an upper age limit for this particular payment?

A. There used to be an upper age limit of 65 but it was removed a few years ago when the Employment Equality (Age) Regulations 2006 were introduced. These now form part of the Equality Act 2010. That means all your employees are entitled to £85.85 p.w. (as of April 1 2012) after the fourth calendar day of sickness absence, provided they earn at least £107 p.w. The maximum period SSP can be paid for is 28 weeks.

There’s no upper age limit for SSP payments. This means all your employees who earn at least £107 p.w. are entitled to receive £85.85 p.w. from the fourth calendar day of sickness absence for up to 28 weeks.
