ICO guidance on the right of access
Important principle. Under the GDPR , all individuals, e.g. employees, consultants, clients and customers, have the right to know what personal data is held about them and they can obtain a copy of that data from the business or organisation which holds it. This is known as the “right of access” and is a fundamental principle of data protection laws. To help you meet this important legal obligation, the Information Commissioner’s Office (ICO) has issued new guidance on the right of access (see The next step ).
Make a request. The guidance is certainly helpful but it’s currently in draft form. This is because the ICO wants to know if the guidance is suitable in its proposed format and whether businesses and organisations need any more detail.
Tip. You have until 12 February 2020 to request any additions to the right of access guidance. This can be done by completing a short online survey (see The next step ). Once the ICO has considered all submitted requests it will publish a final version of the guidance.
