Consultation on carers’ leave

The government is consulting on its proposals to introduce a new statutory right for employees to take one week’s unpaid carer’s leave per year. What’s this all about?

Eligibility

Under the proposals, employees (but not workers) who care for a spouse, civil partner, child, parent, someone living in the same household (other than as an employee, tenant or lodger) or anyone else who reasonably relies on the employee for care would be eligible for the unpaid carer’s leave. The government proposes the leave be restricted to those caring for individuals with physical/mental health problems, a disability or old age issues where the care need is likely to last for a longer period of time, e.g. six to twelve months. It’s not proposed it would apply to ordinary childcare or short-term care.

Consultation questions

The consultation also seeks views on: (1) whether there should be a qualifying service requirement; (2) what the leave can be taken for; (3) what evidence should be required from the employee; (4) whether the leave should only be taken in a single one-week block, or as individual days; and (5) how much notice the employee should give.

The proposed right would enable eligible employees who are unpaid long-term carers to take an annual week off work to provide that care, e.g. to a parent or spouse.
