Right to work checks during lockdown

The Home Office has amended the way employers can establish their defence against the employment of an illegal worker when they are having to check new recruits virtually, rather than in person. The relaxation took effect on 30 March 2020.

Video calls. Checks can now be carried out over video calls and job applicants and existing workers, for example who are proving a new visa has been received, can send scanned documents or a photo of documents using email or a mobile app, rather than the originals. Mark the form as to why it is a scanned copy.

Coronavirus issues. Because of coronavirus, some individuals may be unable to show you their documents so take extra care to ensure that no one is discriminated against as a job applicant or employee. You’ll have eight weeks after the relaxation is lifted to see and copy the original document.

Right to work checks can now be carried out virtually and documents can be scanned rather than seeing originals. But you must see and copy the original within eight weeks of the relaxation being lifted.
