DBS to filter out certain convictions

The government has laid draft legislation, the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (Amendment) (England and Wales) Order 2020 and The Police Act 1997 (Criminal Record Certificates: Relevant Matters) (Amendment) (England and Wales) Order 2020 , which will amend the law in England and Wales such that youth cautions issued to those under 18 at the time will not in future automatically appear on a DBS check. Multiple convictions will also be filtered out following a Supreme Court ruling that this was a breach of human rights. There is no date for implementation of the change as it is to be debated in Parliament later in 2020. In a separate announcement it is proposed to reform the rules on rehabilitation periods after which a conviction is classed as spent and is no longer disclosed.

Fewer potential recruits will have convictions disclosed under government proposals - youth cautions issued to those under 18 will not feature on a DBS check.
