Sharp rise in employment tribunal claims

Quarterly statistics. The employment tribunal quarterly statistics for October to December 2020 have been published (see Follow up ) and they show that single claims have increased by 25% and multiple claims by 82% compared with the same quarter in 2019. The number of single claims (13,225) also represents the highest number lodged in a quarter since January to March 2013.

Causes. This increase is likely to be mainly as a result of redundancies and changes in employment terms caused by the coronavirus pandemic. In particular, there’s been a surge in the number of claims being lodged for unfair dismissal.

Pro advice. Now that the Coronavirus Job Retention Scheme has been extended until 30 September 2021, there will probably be a slowdown in claims until that date, but nevertheless the overall trend in claims continues to be upwards since tribunal fees were abolished in July 2017.

With the number of employment tribunal claims still rising, it’s essential that your employment and dismissal practices and procedures are legally compliant. The pandemic isn’t an excuse for taking shortcuts.
