Fined £1,000 for no insurance certificate
Covered. Under the Employers’ Liability Compulsory Insurance Act 1969,employers must have minimum cover of £5 million to protect staff in the event that they have an accident. A copy of the insurance certificate can be requested by an HSE inspector at any time.
That’s a grand. But, as one employer has just found out, it can be a costly mistake if you don’t produce it when asked. When Dipak Solanki (S) was visited by local HSE inspectors he could not locate his certificate. As a result, he was served with a “notice to produce”. It still did not materialise and S was prosecuted. For his “error” local magistrates have recently ordered him to pay a fine of £1,000.
Trap. Even where an employer has insurance, the courts can still fine you up to £2,500 per day if you have no proof of it, i.e. you’ve no certificate available. So make sure you can locate it easily if asked.
