Serial litigants beware

Scratching about. There is a growing number of serial litigants who trawl job ads simply to bring discrimination claims against unsuspecting employers. One was found to have made over £100,000 just by spending a few hours a day looking for dodgy wording that he could challenge.

Not the big boys. These individuals don’t go after the corporates, they target the smaller businesses which don’t have the time and money to defend a claim. Whilst you would never get your job ads wrong, you could still fall victim to this practice. So wouldn’t it be helpful to know if the individual had tried it on before? The tribunals can’t help you with this as they don’t keep a central database. But a new service will undertake a national search for you for £99 and let you know if your opponent has previously won or lost any tribunal claims. If they have, they’ll certainly back off once they know you’re on to them.

Tip. If they do have history yet don’t back down, disclose your findings to the tribunal. It may help to undermine the individual’s reliability.
