Reform of approved English apprenticeships

Some important changes to approved English apprenticeships came into force on 15 January 2018. How do they affect your agreements?

OFF-THE-JOB TRAINING

The Apprenticeships (Miscellaneous Provisions) Regulations 2017 (SI 2017/1310) , which only apply in relation to England, make it a condition of an approved English apprenticeship that the apprentice must receive off-the-job training, and the agreement (see Follow up ) must specify the amount of time the apprentice is to receive such training during the period of the agreement.

Pro advice 1.Off-the-job training” is training received by the apprentice during their normal working hours for the purpose of achieving the approved apprenticeship standard and which isn’t on-the-job training. “ On-the-job training” is training received for the sole purpose of enabling the apprentice to perform the work to which the agreement relates.

Pro advice 2. Off-the-job training can still include training delivered in the workplace, but it mustn’t be as part of the apprentice’s normal working duties.

PRACTICAL PERIOD

Secondly, the approved English apprenticeship agreement must now specify the period, of not less than twelve months, for which the apprentice is expected to work and receive training.

It’s now a requirement that off-the-job training be provided, and the agreement must specify the amount of such training and last for at least twelve months.
