SEX DISCRIMINATION - 20.08.2019

Gender equality roadmap and sexual harassment consultation

The government has published “Gender equality at every stage: a roadmap for change” and a consultation on sexual harassment. What do you need to know?

Consultations

The roadmap confirms that a consultation will be undertaken on a new employment right to carers’ leave. A consultation on the effectiveness of workplace sexual harassment legislation has now started and runs until 2 October 2019 (see Follow up ).

Pro advice. This consultation covers whether to: (1)  introduce a new legal duty on employers to prevent sexual harassment in the workplace; (2)  strengthen protection against third-party harassment; (3) extend protection to interns and volunteers; and (4) extend the three-month tribunal time limit for bringing discrimination and harassment claims.

A consultation on increasing the transparency of employers’ parental leave and pay policies has also now started as part of a wider consultation - we’ll discuss this in a separate article.

Other matters

The roadmap also says that: (1) technical guidance on sexual harassment at work will be published later in 2019 and will form the basis of a statutory Code of Practice; and (2) the enforcement of equal pay legislation and the gender pay gap metrics will both be reviewed to assess their effectiveness.
