Q&A - Brexit effect on the GDPR?

Q. Is the GDPR affected by Brexit in any way and will anything change in the future?

A. Brexit has absolutely no effect on the GDPR , even though it is EU-derived legislation. When the agreed transition period ends on 31 December 2020 , the GDPR will automatically be incorporated into our domestic legislation by provisions that are contained in the European Union (Withdrawal) Act 2018 . So in practical terms nothing is going to change in the immediate future.

The GDPR’s long-term future in the UK will depend on the trade negotiations, and any deal that’s struck with the EU. However, even if the government retains the right to amend the GDPR , any UK-based business which deals with businesses that are based in the EU will still be required to observe the GDPR . The same situation will apply if there’s a no deal Brexit.

Brexit has no effect on the GDPR . When the transition period ends on 31 December 2020, it will be automatically incorporated into our domestic law. So in practical terms no changes will occur in the immediate future.
