RECRUITMENT - 21.09.2022

End of COVID-19 right to work checks concession

The COVID-19 adjusted right to work checks concession ends on 30 September 2022. What are your options for right to work checks from 1 October 2022?

Concession end date

The adjusted right to work checks process, which enables you to check scanned documents via video call, ceases on 30 September 2022.

Options for right to work checks

From 1 October 2022, only the following checks secure the statutory excuse against liability for an illegal working civil penalty: (1) online checks using the free right to work checking service (see Follow up ) - use this where possible, e.g. those with status under the EU Settlement Scheme or the UK’s immigration system and those who hold a biometric resident permit or card or frontier worker permit; (2) digital checks via the services of a certified Identity Service Provider (IDSP) - you can only use this for valid British or Irish passport holders (including Irish passport card holders) who consent, and you must pay the IDSP’s fees; and (3) manual original document checks - use this for those with other documents.

Pro advice. If you don’t want to adopt checks using an IDSP for British and Irish citizens, you must conduct manual checks instead. You can find a list of IDSPs in the digital identity certification guidance (see Follow up ).

Digital identity certification for right to work checks

From 1 October you can use the right to work checking service (and must use it in some cases), conduct a manual document check or, for British/Irish passport holders, use a certified Identity Service Provider.
