A different perspective?

Figures published by the HSE show that the number of prosecutions has dropped. What does this mean for you?

Change of approach. Figures published by the Health and Safety Executive (HSE) in November 2005 show that the number of prosecutions for health and safety-related offences has actually dropped by around a quarter. It shows that they’ve changed their approach from being a prosecuting enforcement body to more of a pro-active organisation focussed on the prevention of accidents through its provision of advice. So is this a good thing?

Cautious welcome. In theory it should be, but there’s always an element of doubt when the person giving you the advice also has the ability to issue an enforcement notice. A source has told us that inspectors are very keen to avoid giving notices as they feel they can have just as much impact with advice. But be warned; they aren’t going to turn a blind eye to significant risks and they’re just as likely to take enforcement action as before. The November figures also indicate that when they do take action and it results in a prosecution, the average fines have increased by a third.

Good advice. A case which was publicised by the HSE Slips and Trips Focus Group, showed how an inspector had looked at the problems of a workplace where there were significant risks of both slip-related and manual handling injuries. He didn’t issue any notices but took the time to work with the company and find the best option to reduce the risks. His solutions not only solved the problem, but helped identify a method that didn’t cost anything and actually made the processes involved more efficient. The biggest improvements were made through better stock management which made handling easier and cleared aisles from trip hazards. This case shows that they’re willing to give advice which not only solves the problem but which won’t break the bank.

Tip. Don’t assume all inspectors are going to take this approach. If you have a problem you’re sure they’re going to pick up, pre-empt it and ask for advice, quoting the example above.

If you have an issue you’re sure they’ll discover during the inspection, inform them when they arrive and ask for help. It may help you avoid enforcement action and the advice might be better than you expect.
