Working time latest

Opt-out. As you know, the government has successfully preserved the right for UK workers not to be limited to a maximum 48-hour working week since the Working Time Regulations were introduced. However, this opt-out has recently been under attack by a number of EU countries. In June 2006, the matter came up yet again for debate.

Still in place. You’ll be pleased to know that the opt-out remains. However, the issue will re-emerge due to a change in EU presidency. When it does, the government may agree to restrict its use in order to secure concessions in other areas.

Concessions. One proposal mentioned is that if the opt-out can’t be preserved by the growing number of EU countries which want it, the government will agree to its removal provided a maximum working week of 48 hours is averaged over twelve months. Even this scenario would allow you to retain flexibility. As a result, you can continue to use any opt-out agreement that you have in place and do so in the knowledge that any changes will have a lead-in time.

Following more debate by the European Union over the summer, the working time opt-out remains in place; at least for now. This means that you may still continue to use opt-out agreements.
