Q&A - must we provide salary information?

Q. We’ve heard that, to improve pay transparency, employers are now required to disclose salary information in their job ads. Is this true or another rumour?

A. The government has launched an initiative which encourages employers to provide salary information in their job ads and not enquire about a job applicant’s previous pay, but it is not a mandatory or legal requirement. Thus, you are free not to disclose any salary information in your job ads and you may also ask applicants about their salary history (just make sure this question is put to all candidates). This initiative was launched to close potential pay gaps amongst those individuals with protected characteristics, e.g. sex, disability and race.

Whilst it is entirely your choice whether to follow the voluntary initiative, you could easily miss out on good candidates if salary information is not provided in a job ad. For the vast majority of jobseekers, it’s the key piece of information that they look for when considering a new role. If you don’t want to mention the exact salary in a job ad, use a salary band which is realistic and not set too wide.
