New protection for parents and carers

Three government-backed private members’ bills that give parents and carers new employment protections have received Royal Assent. What are they?

New laws

The Neonatal Care (Leave and Pay) Act 2023 will allow eligible employed parents whose baby is admitted to neonatal care to take up to twelve weeks’ paid neonatal care leave (see Follow up ). The Carer’s Leave Act 2023 will create a new right to one week’s flexible unpaid carer’s leave per year for employees caring for a dependant with a long-term care need (see Follow up ). The Protection from Redundancy (Pregnancy and Family Leave) Act 2023 will allow the extension of existing redundancy protections while on maternity, adoption or shared parental leave to also cover pregnancy and a period of time after a new parent has returned to work (see Follow up ).

Implementation dates

The neonatal care leave and pay provisions are expected to take effect from April 2025. The carer’s leave provisions are unlikely to take effect before April 2024. The redundancy protection legislation will come into force on 24 July 2023 but it requires secondary legislation (regulations) to actually extend the protection.
